BijBol is a special app exclusively for the dental students, budding dentists and practicing clinicians.
These Terms and conditions (“Terms”) govern your access to and use of BijBol Mobile Application(platform), BijBol website, and all BijBol Services hereinafter referred as BijBol or “we,” “us” or “our”. These terms apply to SMS, email notifications, APIs, applications, buttons, widgets, advertisements, commercial services, and our other services that link to these Terms (collectively, the “Services”), and any any information, text, links, graphics, photos, audio, videos, or other materials or arrangements of materials uploaded, downloaded or appearing on the Services (collectively referred to as “Content”). By using the Services you agree to be bound by these Terms.
The domain name www.BijBol.com and the BijBol mobile application, are owned and operated by Vinar Health Tech Private Limited, a company duly incorporated under the provisions of the Companies Act, 1956, they are collectively referred to as ‘ʼBijBol”. These Terms and the Privacy Policy applies solely to the information collected by Vinar Health tech Pvt Ltd through the BijBol App (“Application or “Mobile Application”) hosted for BijBol App by Vinar Health tech Pvt Ltd; it does not apply to other online or offline Vinar Health tech Pvt. Ltd. sites, products, or services.
(i). These Terms and the Privacy Policy together constitute a legal agreement binding between you, whether personally or on behalf of a company or an entity (“you” or ”User”) and BijBol (“we,” “us” or “our”) in connection with your visit to the Website or application and your use of the Services
(ii). Please read these Terms carefully by accessing or using these services, you agree to be bound by the terms described herein and all terms incorporated by reference. If you do not agree with all of these terms and conditions, then you are expressly prohibited from using the application and you must discontinue use immediately. By accessing or using our Application it is deemed that you have read, understood, and agree to be bound by all of these Terms and Conditions.
(iii). The Services may change from time to time, at the sole discretion of BijBol. Supplemental terms and conditions or documents that may be posted on the website or Application from time to time are hereby expressly incorporated herein by reference. We will alert you about any changes by updating the “Last updated” date of these Terms and Conditions and you waive any right to receive specific notice of each such change.
(iv). It is your responsibility to periodically review these Terms and Conditions to stay informed of updates. You will be subject to, and will be deemed to have been made aware of and to have accepted, the changes in any revised Terms and Conditions by your continued use of the Application after the date such revised Terms are posted. BijBol doesnʼt take any responsibility or liability for any asset, advantage, loss or disadvantage that arises due to updation of the application. Your access to use of the Mobile Application and Website and the Services will be solely at the discretion of BijBol. These Terms of Use is published in compliance of, and is governed by the provisions of Indian laws, including but limited to:
(vi). The information provided on the Application is not intended for distribution to or use by any person or entity in any jurisdiction or country where such distribution or use would be contrary to law or regulation or which would subject us to any registration requirement within such jurisdiction or country. Accordingly, those persons who choose to access the Application from other locations do so on their own initiative and are solely responsible for compliance with local laws, if and to the extent local laws are applicable.
(vii). The User shall, for their lawful purposes, apply for and secure at their cost all the required registrations, licenses, permits and sanctions and fully comply with all government laws, rules and regulations applicable to use and avail services of BijBol. We shall not be responsible for any irregularities committed in the above said registrations, licenses, permits and sanctions.
(i). As a condition to use our Services, You must be 18 (eighteen) years of age or older to register, use the Services, or visit or use the Application and Website in any manner. By registering, visiting and using the Application or accepting this Agreement, you represent and warrant to BijBol that you are 18 years of age or older, and that you have the right, authority and capacity to use the Application and the Services available through the Mobile Application, and agree to and abide by this Agreement.
(ii). You affirm that You are either at least 18 years of age, or possess legal parent guardian consent, and are fully able and competent too enter into the Terms, conditions, obligations, representations, and warranties set forth in these Terms, and to abide by and comply with these Terms.
(iii). If you are under the age of 13 (thirteen), you must not use this application and if you want to contact us you may only do so through your parent or legal guardian.
(iv). In case You are a supplier or any other User under the age of 18 years and intending to use our application for transactional or educational purpose you may still register with us but we are not responsible for any content published by our users nor for any products or services offered by us unless expressly mentioned in these terms.
(i). Unless otherwise indicated, the Application is our proprietary property and all source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics on the Application (collectively, the “Content”) and the trademarks, service marks, and logos contained therein (the “Marks”) are owned or controlled by us or licensed to us, and are protected by copyright and trademark laws and various other intellectual property rights and unfair competition laws of India. The Content and the Marks are provided on the Application “AS IS” for your information and personal use only. Except as expressly provided in these Terms of Use, no part of the Application and no Content or Marks may be copied, reproduced, aggregated, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted, distributed, sold, licensed, or otherwise exploited for any commercial purpose whatsoever, without our express prior written permission.
(ii). Provided that you are eligible to use the Application, you are granted a limited license to access and use the Application and to download or print a copy of any portion of the Content to which you have properly gained access solely for your personal, non-commercial use. We reserve all rights not expressly granted to you in and to the Application, Content, and the Marks
(i). By using the Application, you represent and warrant that:
(ii). If you provide any information that is untrue, inaccurate, not current, or incomplete, we have the right to suspend or terminate your account and refuse any and all current or future use of the Application(or any portion thereof).
(i). You may be required to register with the Application. You agree to keep your password confidential and will be responsible for all use of your account and password. We reserve the right to remove, reclaim, or change a username you select if we determine, in our sole discretion, that such username is inappropriate, obscene, or otherwise objectionable.
Our content and information on BijBol is governed by the following specific terms and conditions;
(i). We collect, directly or indirectly, and display on BijBol, relevant information regarding the profile of the users, such as their name, specialization, qualification, location, and similar details.
(ii). We take reasonable efforts to ensure that such information is updated at frequent intervals. Although BijBol screens and vets the information and photos submitted by the Users, it cannot be held liable for any inaccuracies or incompleteness represented from it, despite such reasonable efforts.
(iii). The Services provided by BijBol or any of its licensors or service providers are provided on an "as is" and “as availableʼ basis, and without any warranties or conditions (express or implied, including the implied warranties of merchantability, accuracy, fitness for a particular purpose, title and non-infringement, arising by statute or otherwise in law or from a course of dealing or usage or trade). We do not provide or make any representation, warranty or guarantee, express or implied about the Mobile Application or the Services. We do not guarantee the accuracy of any content or information provided by Users on BijBol. To the fullest extent permitted by law we disclaim all liability arising out of the Userʼs use or reliance upon the Application, the Services, representations and warranties made by other Users, the content or information provided by the Users on the Website, or any opinion or suggestion given or expressed by us or any User in relation to any User or services provided by such User.
(iv). BijBol may be linked to the website of third parties, affiliates and partners. We have no control over, and not liable or responsible for content, accuracy, validity, reliability, quality of such websites or made available by/through our Website. Inclusion of any link on the Website does not imply that we endorse the linked site. You may use the links and the services at your own risk.
(v). If we ascertain that you have provided illegal, fraudulent, inaccurate, or incomplete information, including through feedback, we reserve all the rights to immediately suspend your access to BijBol or any of your accounts with us and makes such declaration on the application alongside your name/your companyʼs name/ your clinicʼs name as determined by us for the protection of our business and in the interests of Users. You shall be liable to indemnify BijBol for any losses incurred as a result of your misrepresentations or fraudulent feedback that has adversely affected us or our Users.
The users of BijBol SERVICES are hereby informed not to host, display, upload, modify publish, transmit, update or share any information that —
(i). violates any applicable local, provincial, state, national or international law, statute, ordinance, rule or regulation;
(ii). belongs to another person and to which the user does not have any right to;
(iii). considered obscene, contain pornography or contain “indecent representation of women” within the meaning of the Indecent Representation of Women (Prohibition) Act, 1986.
(iv). is grossly harmful, harassing, blasphemous, defamatory, obscene, pornographic, paedophilic, libellous, invasive of another's privacy, hateful, or racially, ethnically objectionable, disparaging, relating or encouraging money laundering or gambling, or otherwise unlawful in any manner whatever;
(v). harm minors in any way;
(vi). infringes any intellectual property, patent, trademark, copyright or other proprietary rights or rights of publicity or privacy of any third party;
(vii). violates any law for the time being in force;
(viii). deceives or misleads the addressee about the origin of such messages or communicates any information which is grossly offensive or menacing in nature;
(ix). impersonates another person;
(x). contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer resource;
xi). threatens the unity, integrity, defence, security or sovereignty of India, friendly relations with foreign states, or public order, or causes incitement to the commission of any cognisable offence or prevents investigation of any offence or is insulting any other nation.
(xii). threatens public health or safety; promotion of cigarettes or any other tobacco products or consumption of intoxicant including alcohol and Electronic Nicotine Delivery System (ENDS) & like products that enable nicotine delivery except for the purpose & in the manner and to the extent, as may be approved under the Drugs and Cosmetics Act, 1940 and Rules made thereunder;
(xiii). threatens critical information infrastructure.
The terms in this Clause are applicable only to Dentists/Medical Professionals. (“Professionals”)
(i). The Professional(s) shall be duly registered, licensed and qualified to practice dentistry/ provide health care, wellness services, as per applicable laws/regulations/guidelines set out by competent authorities and the Professional shall not be part of any arrangement which will prohibit him/her from practicing medicine within the territory of India. The Professional shall at all times ensure that all the applicable laws that govern the Professional shall be followed and utmost care shall be taken in terms of the consultation/ services being rendered. BijBol strictly recommends Professional(s) to follow the code of ethics and conduct applicable to them while using our application. We shall not be liable and responsible for the information or content of any nature uploaded by the Professionals. We expressly recommend Professionals to restrain from uploading or posting information that is not obtained through legal means and without the consent of the patient concerned. Professionals shall take the indemnity to cover any legal claims filed with respect to their actions
(ii). We, directly and indirectly, collects information regarding the Professionalsʼ profiles, contact details, and practice. BijBol reserves the right to take down any Professionalsʼs profile as well as the right to display the profile of the Professionals, with or without notice to the concerned Professional. This information is collected for the purpose facilitating interaction with the End-Users and other Users. If any information displayed on the Website in connection with you and your profile is found to be incorrect, you are required to inform BijBol immediately to enable us to make the necessary amendments.
(iii). BijBol shall not be responsible or liable in any manner to the Users for any losses, damage, injuries or expenses incurred by the Users as a result of any disclosures or publications made by BijBol, where the User has expressly or implicitly consented to the making of disclosures or publications by BijBol. If the User had revoked such consent under the terms of the Privacy Policy , then BijBol shall not be responsible or liable in any manner to the User for any losses, damage, injuries or expenses incurred by the User as a result of any disclosures made by BijBol prior to its actual receipt of such revocation.
(iv). BijBol reserves the right to moderate the suggestions made by the Professionals through feedback and the right to remove any abusive or inappropriate or promotional content added on the Application. However, BijBol shall not be liable if any inactive, inaccurate, fraudulent, or non- existent profiles of Professionals on the Application.
(v). Professionals explicitly agree that BijBol reserves the right to publish the Content provided by Professionals to a third party including content platforms.
(vi). You as a Professionals hereby represent and warrant that you will use the Services in accordance with applicable law. Any contravention of applicable law as a result of your use of these Services is your sole responsibility, and BijBol accepts no liability for the same.
(vii). BijBol reserves the right of ownership of all Professionalsʼ profile and photographs and to moderate the changes or updates requested by Professionals. However, BijBol takes the independent decision whether to publish or reject the requests submitted for the respective changes or updates. You hereby represent and warrant that you are fully entitled under law to upload all content uploaded by you as part of your profile or otherwise while using WALLDENTʼs services, and that no such content breaches any third party rights, including intellectual property rights. Upon becoming aware of a breach of the foregoing representation, BijBol may modify or delete parts of your profile information at its sole discretion with or without notice to you.
(i). Any practice created Health Record is provided on an as-is basis at the sole intent, risk and responsibility of the Professionals and BijBol does not validate the said information and makes no representation in connection therewith. You should contact the relevant Professionals in case you wish to point out any discrepancies or add, delete, or modify the Health Record in any manner.
(ii). The Health Records are provided on an as-is basis. While we strive to maintain the highest levels of service availability, BijBol is not liable for any interruption that may be caused to your access of the Services.You agree that it shall be your sole responsibility to obtain prior consent of your dependent and shall have right to share, upload and publish any sensitive personal information of your dependent. BijBol assumes no responsibility for any claim, dispute or liability arising in this regard, and you shall indemnify BijBol and its officers against any such claim or liability arising out of unauthorized use of such information.
(iii). BijBol is not responsible or liable for any content, fact, Health Records, medical deduction or the language used in your Health Records whatsoever. Your Professional is solely responsible and liable for your Health Records and any information provided to us including but not limited to the content in them.
(iv). BijBol has the ability in its sole discretion to retract Health Records without any prior notice if they are found to be shared incorrectly or inadvertently. BijBol will follow the law of land in case of any court or jurisdiction mandates to share the Health Records for any reason. You agree and acknowledge that BijBol may need to access the Health Record for cases such as any technical or operational issue of the User in access or ownership of the Records.
(v). To the extent that your Records have been shared with BijBol or stored on any of the BijBol products used by Professionals you are visiting, and may in the past have visited, You hereby agree to the storage of your Records by BijBol pertaining to such previously visited clinics and hospitals who have tie ups with BijBol for the purposes of their business and for BijBol's services including but not limited to the usage and for storage of Record in India and outside India, in accordance with the applicable laws and further agree, upon creation of your account with BijBol, to the mapping of such Records as may be available in BijBolʼs database to your User account.
This service is specifically governed by the following terms and conditions;
(i). BijBol is only a platform to facilitate transaction. Through the Application, we facilitate the purchase of dental/medical equipment, other products and services (“Goods and Services”) offered for sale by Third-Party Vendor or authorised sellers. You understand and agree that BijBol merely provide hosting services to You. All items offered for sale on the Application, and the content made available by the Third-Party Vendor, are Third-Party user generated content and Third-Party products. We have no control over such Third-Party user generated content and/ Third-Party products and does not - originate or initiate the transmission, or select the sender/recipient of the transmission, or the information contained in such transmission. The authenticity and genuineness of the Goods and Services made available by the Third-Party Medicine Vendor through the Website shall be the sole responsibility of the Third-Party Vendor. You understand and agree that BijBol shall have no liability with respect to the authenticity of the Goods and Services being facilitated through the Application.
(ii). You understand and agree that all commercial / contractual terms, with respect to the sale/ purchase/ delivery and consumption of the Goods and Services are offered by and agreed to between You and the Third-Party Vendor and the contract for purchase of any of the Goods and Services, offered for sale on the Website by the Third-Party Vendor shall strictly be a bipartite contract between You and the ThirdParty Vendor.
(iii). The commercial / contractual terms include without limitation - price, shipping costs, payment methods, payment terms, date, period and mode of delivery, quality, warranties related to these Goods and Services offered for sale by the Third-Party Vendor, and after sales services related to such Goods and Services. BijBol does not have any control over, and does not determine or advise or in any way involve itself in the offering or acceptance of, such commercial / contractual terms offered by and agreed to, between You and the Third Party Vendor.
(iv). BijBol does not make any representation or warranty as to legal title of the Goods and Services offered for sale by the ThirdParty Vendor on the Application. At no time shall any right, title, claim or interest in the products sold through or displayed on the Application vest with BijBol nor shall BijBol have any obligations or liabilities in respect of any transactions on the Website. You agree and acknowledge that the ownership of the inventory of such Goods and Services shall always vest with the Third-Party Vendor, who are advertising or offering them for sale on the Website and are the ultimate sellers.
(iv). You agree and acknowledge that the Third-Party Vendor shall be solely responsible for any claim/ liability/ damages that may arise in the event it is discovered that such Third-Party Vendor do not have the sole and exclusive legal ownership over the Goods and Services that have been offered for sale on the Application by such Third-Party Vendor, or did not have the absolute right, title and authority to deal in and offer for sale such Goods and Services on the Website.
(iv). You accept and acknowledge that BijBol is not responsible for any unsatisfactory, delayed, non-performance or breach of the contract entered into between You and the Third-Party Vendor for purchase and sale of goods or services offered by such Third-Party Vendor. BijBol cannot and does not guarantee that the concerned Third-Party Vendor will perform any transaction concluded on the Website
(vi). BijBol is not responsible if the Third-Party Vendor(s) does not satisfy the contract for sale of Goods and Services which are out of stock, back ordered or otherwise unavailable, but were shown as available on the Website at the time of placement of order by You.
(vii). BijBol shall not and is not required to mediate or resolve any dispute or disagreement between You and Third-Party Vendor. In particular, BijBol does not implicitly or explicitly endorse the sale or purchase of any items or services on the Website.
(viii). Any liability of BijBol for any failure of any Third-Party Service Provider shall be restricted to the amount paid by you towards availing and your sole remedy for any failure to provide any Service by any Third-Party Service Provider shall be for a refund of any amounts already paid by you for such Service.
(ix). You agree and acknowledge that the respective Third-Party Medicine Vendor are exhibiting Third-Party Content which includes catalogue of dental or medical equipment, products or services, and information in relation to such products or services, on the Application.
(x). The Third-Party Content available on the Website, including but not limited to, text, copy, audio, video, photographs, illustrations, graphics and other visuals, is for general information purposes only and does not constitute either an advertisement/ promotion of any product being offered for sale by the Third-Party Vendor on the Website or any professional medical advice, diagnosis, treatment or recommendations of any kind.
(xi). You acknowledge and agree that such Third-Party Medicine Vendor shall be solely responsible for ensuring that such Third-Party Content made available regarding the Goods and Services offered for sale on the Website, are not misleading and describe the actual condition of the Goods and Services. In this connection, it is solely the responsibility of the concerned Third-Party Vendor(s) to ensure that all such information is accurate in all respects and there is no exaggeration or over emphasis on the specifics of such Goods and Services so as to mislead the Users in any manner.
(xii). You acknowledge and understand that BijBol provides no warranty or representation with respect to the authenticity/ veracity of the information provided on the Website and You must run Your own independent check. It is hereby clarified that the Third-Party Vendor(s) are offering the Goods and Services for sale to You and they are responsible for procuring the appropriate licenses for the same under the Drugs and Cosmetics Act ,1940 read with the Drug rules and the Pharmacy Act. You agree and acknowledge that You shall not hold BijBol responsible or liable for any damages arising out of such reliance on Third-Party user generated content by You.
(i). As a job-seeker you agree that any jobs, employment, internship opportunities temporary or permanent in nature provided through BijBol by a Third party or other Users of our application is only a service provided by us without any pecuniary interest with respect to this specific service. Although we make efforts and try to vet any false posts, we bear no responsibility for the genuineness or authenticity or misinformation of the job posting. Users are fully responsible to verify the content or information relating to jobs provided by the Third parties and other Users on BijBol. We are not liable or responsible for content, accuracy, validity, reliability, quality of such job posts or employment opportunities made available by/through our Application and will not be responsible for any payments made to a third-party (including verified companies).
(ii). As a recruiter you agree that any misuse, or fraudulent use of this platform will result in deactivation and/or further action. Further, it is your responsibility to ensure any job postings or employment opportunities provided by you should not violate any applicable local, state and national laws in India. We expressly and strictly bar you from posting any information which is not authentic and we do not guarantee the accuracy of any content or information provided by you.
(i). Please note that some of the content, advise, text, data, graphics, images, information, suggestions, guidance, and other material (collectively, “Information”) that may be available on the Application (including information provided in direct response to your questions or postings) may be provided by individuals in the dental and/ or medical profession. The provision of such Information does not create a licensed dental/medical professional-patient relationship, between BijBol and you and does not constitute an opinion, medical advice, or diagnosis or treatment of any particular condition. Information in this Application should not be considered as a medical opinion in any way whatsoever and does not establish a Doctor-Patient relationship. The information is not intended to be a substitute for professional advice/opinion. We recommend You to always seek advice of your dental/medical/health care professional regarding your specific issue.
(ii). It is hereby expressly clarified that, the Information that you obtain or receive through BijBol, and its employees, contractors, partners, sponsors, advertisers, licensors or otherwise on the Website is for informational purposes only. We make no guarantees, representations or warranties, whether expressed or implied, with respect to professional qualifications, quality of work, expertise or other information provided on the Website. In no event shall we be liable to you or anyone else for any decision made or action taken by you in reliance on such information.
(iii). BijBol does not guarantee or make any representation with respect to the correctness, completeness or accuracy of the advise conducted and reports generated by Third-Parties or any professionals.
(i). We allow advertisers to display their advertisements and other information in certain areas of the Application, such as sidebar advertisements or banner advertisements. If you are an advertiser, you shall take full responsibility for any advertisements you place on the Application and any services provided on the Application or products sold through those advertisements. (ii). Further, as an advertiser, you warrant and represent that you possess all rights and authority to place advertisements on the Application, including, but not limited to, intellectual property rights, publicity rights, and contractual rights. As an advertiser, you agree that such advertisements are subject to laws relating to advertising, any rules and regulations in India. We simply provide the space to place such advertisements, and we have no other relationship with advertisers.
(i). You agree not to hold BijBol or any of its officers, employees, agents responsible or accountable for any of your listing, postings or information and nor shall we, our officers, employees or agents be liable for any misuse, illegal activity or third party content as most postings, listings or information are generated by various users directly and we do not have any role in the creation, publication or distribution of the posting, listing or information, nor are we in a position to have editorial control over the substance or content contained in the listings, postings, or information, save and except to the extent provided in sec 3 above.
(ii). You understand and agree that we do not guarantee the accuracy or legitimacy of any listing, posting, information by other users. You further agree that we are not liable for any loss of money, goodwill, or reputation, or any special, indirect, or consequential damages arising out of your use of the site or as a result of any sale, purchase of goods and services with other users of the site. We also cannot guarantee continuous or secure access to our Services.
(i). You agree that these terms and Agreement and any contractual obligation between BijBol and User will be governed by the laws of India.
(ii). This agreement shall be subject to the exclusive jurisdiction of the Courts of Hyderabad, Telangana, India.
(i). If the Parties are unable to resolve a Dispute through informal negotiations, the Dispute will be finally and exclusively resolved by binding arbitration. There shall be three arbitrators, one arbitrator to be appointed by each of the parties and the third arbitrator to be appointed by the two arbitrators so appointed. The dispute shall be resolved in accordance with the Arbitration and Conciliation Act, 1996 and the seat of such arbitration shall be at Hyderabad and the language to be used in the arbitration proceedings shall be English.
(i). The provisions of these Terms are severable. If any part or provision of this Agreement shall be held illegal, unenforceable, invalid or in conflict with any law of a Centre, state or local government having jurisdiction over this Agreement, the validity of the remaining portion or portions shall not be affected thereby
(i). Neither party will incur any liability to the other party on account of any loss or damage resulting from any delay or failure to perform all or any part of this agreement if such delay or failure is caused, in whole or in part, by events, occurrences or forces beyond the reasonable control without the negligence of such party.
(i). Waiver by either party of any default by the other party shall not be deemed a waiver of any other default. No provision of this agreement shall be deemed waived, amended or modified by either party, unless such waiver, amendment or modification is in writing and signed by the authorized representative of the party against whom it is sought to enforce such waivers amendment or modification.
(i). The article, section and paragraph headings and subheadings contained are for reference and convenience only and shall not affect in any way the meaning or interpretation of this these Terms.
(i). These Terms constitutes the entire agreement and understanding between the parties relating to the subject matter of this agreement and supersedes all prior writings, negotiations, representations or understandings with respect to the maters referred to herein.
